Rental Agreement

1. Booking

1.1. To make a booking, you must be at least 18 years of age or accompanied by an adult.

1.2. You can book our services online or by phone.

1.3. Bookings are subject to availability and may be subject to change or cancellation.

1.4. We reserve the right to refuse or cancel any booking for any reason.

2. Payment and Deposit

2.1. Payments for all services are taken in advance via card transactions either online or in-store

2.2. Payment for the whole hire period is required before hire commences along with the completed booking form. 

2.3. Proof of identity may be required in the form of a valid driving license or passport. 

2.4. For group bookings, a deposit of 50% of the total booking amount will be required. Full payment is then required 14 days in advance of the activity start date. If the booking is made less than 14 days before the event, then full payment will be required upon booking. The date and time will be held until payment is received. 

2.5. Hamble Paddle reserves the right to cancel bookings should the payment not be received within the specified time.

3. Cancellation, Rescheduling, and Refunds

3.1 Refundable if the booking is under or equal to £200 and cancelled at least a full **24h** prior to the activity start time.

3.2 Refundable if the booking is over £200 and cancelled at least a full **72h** prior to the activity start time.

3.3 If the conditions on the day aren’t ideal but the activity is still taking place, refunds & rescheduling will only be provided under special circumstances.

3.4 We reserve the right to cancel your booking due to adverse weather conditions or any other reason beyond our control. This includes but is not limited to dangerous winds, lightning forecasted, or if the manager judges that the customers will not maintain their ability to cope with the conditions during the session.

3.5 If we cancel your booking due to adverse weather or a reason beyond our control, you will be entitled to a rescheduled booking or voucher only. Any other reason for us cancelling your booking, such as but not limited to late arrival, being under the influence of drugs or alcohol, rudeness to staff, or concerns about capability and safety, will not be refunded or rescheduled.

3.6 Where customers can not attend their activity for reasons beyond their control E.g., for public transport strikes, Hamble Paddle will offer a digital voucher to the value of the booking, which can be redeemed within 12 months.

4. Equipment and Late Returns

4.1. Hires that are returned late will have a late fee of £50 applied to each item hired.

4.2. Late fees are payable before leaving the Hamble Paddle premises. 

4.3. It is the responsibility of the customer using the equipment to report any damage caused during the activity. 

4.4. By participating in a hire, the customer thereby agrees to take responsibility for and pay for any damage caused by improper use.

4.5. Any damage to equipment caused by the customer during a hire will have a damage fee applied. 

4.6. Damage fees are payable before leaving the Hamble Paddle premises. 

4.7. Damage fees are

£35 for a punctured paddleboard.

£60 for a torn wetsuit.

£80 for a lost paddle.

£200 for a broken fin box.

£500 for a replacement kayak.

£500 for a replacement paddleboard.

5. Safety

5.1. All customers are to sign the activity Liability Waiver and Release of Liability Form to acknowledge and accept the inherent risks involved with SUP and kayak rentals.

5.2. For all hires, users must be 12+ and, if under 18 years old, must be accompanied by an adult while using equipment.

5.3. If the customer is under the age of 18, all aspects of our safety information form (waiver) must be read and understood by the customer and signed by a legal guardian who must be over the age of 18.

5.4. If you are perceived to be under the influence of alcohol or illegal drugs, you will not be permitted to undertake any activities with Hamble Paddle.

5.5. All customers must review the safety briefing.

5.6. All customers are required to correctly wear a buoyancy aid (supplied by Hamble Paddle) for the duration of the hire and at the water’s edge.

6. Liability 

6.1. Hamble Paddle is not liable for any injury, loss, or damage, direct or indirect, arising from the use of our equipment.

6.2. The customer agrees to indemnify and hold Hamble Paddle harmless from any claims, damages, or expenses arising from your use of its equipment.

6.3. Hamble Paddle has no liability to the customer if it is unable to fulfil a booking due to an event of force majeure. In the event of us being unable to fulfill your booking, our liability to you shall not exceed the agreed cost of the hire.

6.4. Except where expressly permitted under the Data Protection Act 1998, Hamble Paddle will only use your personal details in connection with your booking arrangements, unless you agree otherwise.

7. Insurance

7.1. Hamble Paddle carries public liability insurance, which covers any injury, loss, or damage to third parties caused by negligence.

7.2. You are responsible for any loss or damage to our equipment while it is in your possession. 

7.4. You are responsible for any injuries to others and loss or damage to others possessions or vessels.

8 Responsibilities

8.1 By signing this agreement, the customer is offering to hire equipment from Hamble Paddle; at any time until they take payment from me, Hamble Paddle may decline my offer.

8.2. If the customer is hiring the equipment for someone under the age of eighteen, they accept full legal responsibility for them and for their compliance with the terms and conditions of this agreement as they apply to that person.

8.3 The customer assumes full responsibility for the equipment listed on the booking and the associated accessories.

8.4 The customer agrees to obey all local regulations and all lawful directives from appropriate emergency or law enforcement personnel while operating or renting the watercraft. The customer agrees to obtain any required local licenses.

8.5. The customer agrees not to use the equipment as a competitor in any race.

8.6. The customer declares that they are capable of operating the equipment and find it in good working order, condition, and repair. 

8.7. The customer will not be under the influence of drink or drugs and understands that if Hamble Paddle believes them to be so, they can terminate this agreement and take the equipment back without refunding me.

8.8. The customer shall bear all risk of damage or loss of the equipment, or any portion thereof, including but not limited to damage and theft, and shall pay Hamble Paddle the cost of repair or "as new" replacement in line with 4.7. I authorise Hamble Paddle to charge the credit card taken during the reservation process for the cost of repair or replacement in the event of, but not limited to, damage, loss, or theft of the equipment.

8.9. I understand that I am liable for all dirty, damaged, lost, or stolen equipment and any fees associated with the listed equipment and that all equipment must be returned in good condition as determined by Hamble Paddle. "Loss" includes confiscation as a result of my having breached any local rules, regulations, or bylaws when using the paddleboard.

8.10. The customer understands that they are hiring the listed equipment at their own risk and that the hire fee does not include any insurance for their benefit.

8.11. The customer understands that they are responsible for returning the listed equipment at the agreed-upon time on the due date of the hire period as shown on the booking and that a late fee will be charged for items that are overdue.

9 Changes to Terms and Conditions and Rental Agreement 

9.1. Hamble Paddle reserves the right to change these terms and conditions at any time without prior notice.

9.2. By booking our services, the customer agrees to these terms and conditions.

10 Miscellaneous 

10.1 Hamble Paddle does not have any responsibility whatsoever for loss or damage to your personal belongings.
